Former Prime Minister Zapatero remains under judicial investigation, but the court has decided not to impose any restrictions on his rights at this stage. The case, led by Judge José Luis Calama, centers on alleged crimes related to the state-backed rescue of Plus Ultra airline and the discovery of jewels of unknown origin in Zapatero’s official office safe. Despite calls from several parties for measures such as pre-trial detention or passport withdrawal, the judge found these requests disproportionate and declined to grant them.

The decision follows Zapatero’s initial court appearance, where he addressed questions about both the Plus Ultra operation and the jewels. According to the judge’s order, Zapatero’s testimony did not dispel the existing suspicions of influence peddling, membership in a criminal organization, and document falsification regarding the airline rescue, nor of tax fraud and smuggling in relation to the jewels. However, the court emphasized that the investigation is still in its early stages, and the evidence could either strengthen or weaken as the process continues.

Judge Calama highlighted the importance of respecting procedural guarantees and avoiding premature sanctions. He referenced constitutional jurisprudence to support his approach, underlining that precautionary measures should never serve as a form of early punishment. The judge had previously rejected a police request to search Zapatero’s home, applying the same principle of proportionality.
