In 2025, Spain launched a procedure that could impact the country’s international relations. The Attorney General authorized an inquiry related to events in the Gaza Strip. The focus is on Israel’s actions, which may fall under the definition of grave breaches of international law and humanitarian standards.
The initiative came from the Department of Human Rights and Historical Memory. Representatives of the National Court and experts in international cooperation joined the effort. Their goal is to determine whether there were acts that could be classified as crimes under the Spanish Criminal Code, particularly those related to war crimes and human rights violations.
The document, signed by the prosecutor’s office, states that Spain is obligated to cooperate with international judicial bodies. Currently, two proceedings are already underway worldwide: one at the International Court of Justice, the other at the International Criminal Court. Spanish authorities emphasize that the country must fulfill its obligations under international treaties and agreements.
The Prosecutor’s Office clarified that the main goal is to collect and preserve evidence that may be needed by the competent authorities. This will enable Spain to fulfill its obligations to support international investigations and protect human rights. The agency also reminded that their actions are in line with the recommendations of the UN independent commission, which called on all countries to assist in investigating the events in Gaza.
