Valencia Court Again Refuses to Open Case Against Mónica Oltra

High-profile case of alleged cover-up—court finds no grounds

For the second time, the Valencia court has found no grounds to prosecute Mónica Oltra. Attempts by the prosecution to have the case reviewed have failed. The decision has sparked significant public reaction.

A court in Valencia has once again declined to proceed with the case against former Vice President of the Valencian Community Government, Mónica Oltra. The high-profile case involves allegations of concealing information about the sexual harassment of a minor under state care. The focus is on the actions of Oltra’s former husband, as well as the possible involvement of the ex-official herself and her associates in attempts to hide the incident.

In December 2025, the judge of Valencia’s Investigative Court No. 15 rejected another attempt by the prosecution to initiate a trial. Previously, in June, the court had issued a similar decision; however, after appeals by civil organizations and political groups, including Vox and Gobierna-te, the case was reconsidered. Despite this, the judge maintained her position, finding insufficient grounds to move the case to trial.

In her ruling, the judge emphasized that the main task at this stage is to carefully assess the validity of the accusations to prevent unwarranted prosecution. According to her, none of the prosecution parties were able to clearly and specifically substantiate the suspicions against each individual involved in the case.

Court’s Arguments

The judge emphasized that charges must be individualized and supported by specific evidence for each incident and each suspect. In this case, in her view, the prosecution failed to provide sufficient evidence to justify a trial. The prosecutor’s office also found no criminal offense in the actions of Oltra and her former colleagues.

In June 2024, after the trial court dismissed the case, the appellate court ordered the investigation to continue. However, even after further review of new evidence and prosecution arguments, the court again concluded that there were insufficient grounds to proceed with a trial.

The ruling also notes that none of the prosecution parties was able to individualize the evidence or clearly link it to the actions of specific individuals. This became one of the key factors influencing the court’s decision.

Reaction from the parties

The court’s decision sparked a strong reaction among the public and politicians. Prosecutors expressed disappointment and announced they would continue to pursue a review of the case. Meanwhile, Oltra’s supporters believe the ruling confirms there was no basis for the charges and demonstrates the fairness of the judicial system.

The court ruling also notes that at this stage, an appeal filed by one of the parties is being considered. This means the process may move forward if higher courts find the prosecution’s arguments convincing.

Case Timeline

The Monica Oltra case began with accusations against her former husband, who was suspected of sexually harassing a minor under state care.
