Authorities impose new restrictions on rentals and housing prices

Spain has approved new rental rules, introducing limits on rent increases and automatic lease extensions. The decision affects millions of tenants and property owners.

The introduction of new rental regulations in Spain has become one of the most discussed decisions in recent months. For many families and tenants, these changes offer protection against sharp price hikes and unexpected evictions. Amid economic instability caused by external conflicts and rising living costs, the government has decided to intervene in the rental market to ease the pressure on citizens.

On Friday, the Council of Ministers approved a package of anti-crisis measures aimed at mitigating the economic crisis linked to events in the Middle East. Among these measures, a separate decree was adopted to regulate the housing rental market. This document provides for the automatic extension of most rental contracts and limits annual rent increases.

New rental regulations

Under the new rules, all housing rental contracts signed for long-term residence and set to expire before the end of 2027 may be automatically extended for up to two years. The contract terms remain unchanged, and rent increases are capped at two percent per year. Exceptions apply only to short-term and tourist rentals or when the owner intends to use the property personally or both parties agree on new terms.

To obtain an extension, the tenant must officially notify the property owner before the current contract or active extension expires. The owner cannot refuse except in cases strictly defined by law. This new measure aims to reduce uncertainty for tenants and prevent sudden changes to living conditions.

Political battle over the law

The decree took effect after publication in the BOE on March 21, but its future depends on a vote in the Congress of Deputies. Within 30 days, Parliament must either approve or reject the measures. If supported, the new rules will remain in force until the end of 2027. Otherwise, the decree will expire and new extensions will not be possible for contracts ending after May.

The adoption of the law sparked intense debate among politicians. To approve the decree, the government needs support from several parties, including Junts and PNV. However, Junts representatives have already voiced dissatisfaction, considering the measures overly interventionist and unfair to small property owners. Opposition parties PP and Vox also spoke out against it, making the outcome of the vote uncertain.

Impact on the market and tenants

Rent cap and automatic contract renewal could significantly shift the balance in the housing market. For tenants, this means greater stability and protection from unexpected expenses. Apartment owners, on the other hand, fear reduced profitability and increased administrative burdens. If the decree is rejected, all renewals processed from March 21 to the day of the vote will remain valid. However, for new contracts expiring after May, the option for automatic renewal will disappear. This creates additional uncertainty for both sides of the market.

Context and similar cases

In recent years, Spain has already faced the need to regulate the rental market. In 2022, amid the pandemic and economic difficulties, authorities temporarily capped rent increases and imposed eviction moratoriums. These measures were considered effective in protecting the most vulnerable groups, although they sparked debate among property owners. Similar initiatives have been taken in other European countries, where rising housing costs have become a key social issue. Now Spain is once again turning to active state regulation to contain the impact of external crises and support stability in the housing market.
