A recent case in the Canary Islands has served as a wake-up call for everyone working with digital technologies in the legal sector. One lawyer’s mistake resulted not only in a personal fine, but also raised questions about trust in modern tools.
The spotlight fell on a lawyer who submitted 48 court decisions generated by AI software. All of these documents turned out to be either completely fabricated or riddled with errors and unrelated to the case at hand. The court chamber noted that the lawyer made no attempt to verify the authenticity of the information, despite having easy access to official databases.
Court’s response
The judges emphasized that such actions violate basic principles of professional ethics and undermine trust in the justice system. The ruling stated that the lawyer not only ignored the need to check case numbers and dates, but also failed to compare the data with free government resources. This behavior was deemed an abuse of trust and a breach of standards of good faith.
As a result, the lawyer was fined 420 euros. This amount was calculated based on the annual subscription fee for a specialized legal artificial intelligence service that could have prevented such an error. The court took into account the admission of guilt and the lawyer’s remorse, so the fine was reduced by half.
Implications for the profession
The case did not end with just a financial penalty. Information about the misconduct was forwarded to the professional bar association, which is now considering possible disciplinary measures. The lawyer himself promised to use artificial intelligence only in accordance with all standards in the future and has already signed up for digital literacy courses.
The judicial panel specifically noted that even a single suspicious reference should have alerted a professional. Using generative tools without human oversight was deemed unacceptable, especially in such a sensitive area as law. Violating standards can have serious consequences not only for the individual specialist, but also for the entire system.
