Spanish Constitutional Court Denies Release of Santos Serdán

Judicial intrigue around Santos Serdán continues – why didn’t the court change its decision

Spain’s Supreme Court has rejected a petition to release the former party official. The decision was made after considering the arguments presented by the defense. Details of the case remain in the spotlight.

On Monday, Spain’s Constitutional Court put an end to the case regarding the temporary release of former Socialist Party organizational secretary Santos Cerdán. The judges of the second section, after reviewing the defense’s appeal, found no grounds to change the previous decision ordering his detention.

A petition to review the preventive measure was filed at the end of July. Cerdán’s lawyers called for the issue to be considered immediately, without waiting for input from the other parties involved. However, the judges found no signs of particular urgency in the case and postponed the discussion until September. Following a thorough analysis, the Constitutional Court confirmed that the defense’s arguments do not raise any constitutionally significant points that could affect the outcome of the proceedings.

The court’s decision notes that the policy of not interfering in the decisions of ordinary courts on temporary measures remains in effect. The judges emphasized that Cerdán’s detention was justified and does not amount to pressure. In June, an investigating judge at the Supreme Court ordered Cerdán to be remanded in custody, fearing that his release might lead to the destruction of evidence or hinder the investigation. The defense’s appeal did not change the court’s position: the risk of interference with the investigation was considered real and substantiated.

Thus, the attempt to secure the release of the former party official has not succeeded at this stage. Serdán’s legal case remains one of the most widely discussed topics in Spanish politics and the judiciary.
