Madrid court acknowledges VAT calculation errors for regional TV channel

The Audiencia Nacional has ruled that Telemadrid miscalculated VAT for the years 2012–2014. The court found that the channel cannot fully deduct the tax. This decision may also impact other state media.

Telemadrid is required to pay 17 million euros to the state budget following a decision by the Audiencia Nacional, which found violations in value-added tax calculations for 2012–2014. The court concluded that the regional TV channel used an incorrect method for determining the share of commercial activity, allowing it to claim full VAT deductions. Now, the channel loses the right to a 100% tax refund, which may also affect other state-owned media outlets.

The court ruling notes that Telemadrid cannot treat all of its activities as commercial. According to the tax authorities, only certain programs related to advertising and the sale of its own products fall under economic activities subject to VAT. The rest of the broadcasting, associated with fulfilling its public mission, is not considered commercial and does not entitle the broadcaster to a tax deduction. It was precisely the attempt to include a larger share of programs in the commercial segment that caused the dispute.

Change in the tax authorities’ position

The issue of VAT deduction procedures for state television channels arose back when the Ministry of Finance was headed by Cristóbal Montoro. At that time, the ministry changed its approach to calculating tax deductions for public media, dividing their operations into two segments: public service and commercial activities. According to the tax authorities, only the commercial segment qualifies for full VAT deduction. Telemadrid tried to expand the definition of commercial activity in order to maximize its tax benefits, but the tax office and the court did not agree with this approach.

Implications for the sector

The legal dispute began in 2022, when the Central Economic-Administrative Tribunal ordered Telemadrid to pay the disputed amount. The channel tried to appeal this decision, but the Audiencia Nacional rejected the complaint. The ruling emphasized that public television channels cannot be equated with private companies, since part of their funding comes from the budget and subsidies. This limits their right to tax deductions compared to commercial broadcasters.

The court’s decision could set a precedent for other regional channels and Radio Televisión Española, which also combine public service and commercial activities. They will now have to take the new restrictions into account when calculating their tax obligations. According to Spanish media, the Audiencia Nacional’s decision can be appealed to the Supreme Court.
