Why Thousands of Disability Pension Applications in Spain Are Rejected. Many Spaniards are denied disability pensions not because of their diagnosis, but due to formal errors. The key factors are medical documentation, employment history, and timing of the application. We explain how to avoid common pitfalls.

In April, the Spanish Social Security system allocated more than €14.3 billion to pension payments, of which over a billion went to disability pensions. However, a significant number of permanent disability applications never reach the payment stage: according to INSS data, the reason is often not the severity of the illness, but mistakes made during the application process.

The most common problem is incomplete or incorrectly prepared medical documents. Even if the diagnosis is clear, the absence of objective evidence or a report from an authorized medical institution may lead to denial. It is important that all certificates are up to date, include the results of examinations, and are signed by qualified professionals.

Another typical mistake is trying to obtain a higher degree of disability than is actually justified. In Spain, there are four levels: partial, total, absolute, and grande invalidez. Each requires a separate evaluation and clear justification. If the applicant submits documents before the consequences of the illness have stabilized, or if the medical board believes that the condition may still change, the review of the case is postponed or the application is rejected.

Work experience requirements

To receive a disability pension, both your health condition and your insurance record are important. If the disability is due to a common illness, those under 31 need a record of at least one third of the period since age 16, and those over 31 need a quarter of the period since age 20, but no less than five years (1825 days). For those not registered as employed, the minimum insurance period is 15 years, of which three must be within the last 10 years. In cases of occupational injury or disease, there are no insurance period requirements.

In April, the average disability pension amounted to €1,529 for absolute disability and nearly €2,590 for grande invalidez. However, not everyone who seeks support is able to receive these payments.

How to avoid rejection

Before submitting documents, it is important to thoroughly check that all medical statements are complete, ensure that the consequences of the illness are documented and not subject to further changes, and calculate whether you have enough insurance contributions. Mistakes at any of these stages may result in denial, even if the diagnosis itself is unquestionable.
