Transferring Property in Spain: Which Is More Beneficial—Gift or Inheritance? In Spain, both inheritance and gifting of real estate to relatives are subject to inheritance and gift taxes. Here, when transferring property to children, spouses, or parents, the tax rate can be reduced by 99%, and if the property value does not exceed one million euros, the tax is completely waived. For other relatives, such as uncles or nephews, smaller deductions apply—up to 250,000 euros. In other regions, the conditions may differ, and sometimes both gifts and inheritances are taxed almost equally.

When gifting an apartment, the tax burden may be higher due to additional requirements. In addition to ISD, the donor must declare any potential profit in the IRPF declaration if the property’s value has increased since purchase. The exception is if the donor is over 65 years old and transfers their main residence. The recipient of the property must also pay the municipal land value increase tax (plusvalía municipal) if the plot’s price has risen during the period of ownership.

In the case of inheritance, IRPF does not apply, and the capital gains tax is paid by the heir. In most regions, spouses and children benefit from additional deductions and exemptions, making inheritance a more advantageous option. Experts note that the absence of capital gains tax for the deceased owner is often a decisive factor in favor of inheritance, especially if the property has significantly increased in value over the years of ownership.

In some cases, gifting may be justified if there is a need to settle property issues in advance or to ensure control over the transfer of ownership. However, from a tax perspective, inheritance is usually less costly, especially for close relatives. It is important to note that rules and rates vary between autonomous communities, so it is recommended to review local regulations before making a decision.
