The essence of the new regulation is the expansion of the list of pathologies for which early retirement does not come with the standard reduction in pension payments. Now, if a person meets all the criteria, they may receive 100% of their entitled pension, even if they retire at 56 instead of after 65.

Who is eligible for early retirement

The right to early retirement without reductions is not granted to everyone, but only to those with a officially certified disability of at least 45%. It is important that the condition is included in the approved list — for example, Parkinson's disease, Huntington's disease, severe spinal cord injuries, multiple system atrophy, corticobasal degeneration, spinal muscular atrophy, systemic scleroderma, advanced stages of kidney failure, and a number of others.

It is not enough just to have the diagnosis: a number of conditions must be met, including work experience and confirmation that the disability has accompanied the person for at least five years during their working life.

Key requirements

To qualify for early retirement without reduced payments, you must:

  • have an officially certified disability of at least 45%;
  • the illness must be included in the special list;
  • insurance contribution record — at least 15 years;
  • at least five years of this record must be with the current disability;
  • be employed or have a status equivalent to employment at the time of application.

Each requirement is checked separately, and automatic approval is not provided. It is important to gather all documents in advance and make sure that your employment record and diagnosis meet the requirements.

Retirement age and pension amount

For those who meet the criteria, the minimum retirement age is reduced to 56. This is 10 years earlier than the standard age, which in Spain currently exceeds 65. At the same time, the pension amount is not reduced: if all conditions are met, a person receives 100% of the entitled sum.

Unlike other cases of early retirement, where payments are automatically reduced, here the state recognizes special circumstances and does not apply penalty coefficients.

Which illnesses grant the right to early retirement

In 2026, the list of diseases was expanded: 11 new pathologies have been added, including severe neurological and systemic diseases. This decision was made because many of them significantly limit the ability to work for many years.

According to ministry estimates, the innovation may apply to about 50,000 people across the country. This is not a broad reform, but a targeted measure for those who objectively cannot work until the usual retirement age.

What to check before submitting your application

Before applying for early retirement, it is important to check carefully: whether the diagnosis matches the official list, if the required percentage of disability is met, whether you have enough work experience, and if the five-year period of living with the disability is documented. Mistakes or missing documents may result in denial.

The administrative process requires precision: each item must be supported by certificates and medical reports. Only when all conditions are fully met can you count on getting early retirement without loss.

How it differs from other early retirement options

In Spain, there are other categories of workers who may retire early—for example, people with a 65% disability or those in hazardous professions such as firefighters. However, in most such cases, the pension amount is reduced depending on work history and age. The new measure stands out in that for certain diseases and a disability from 45%, the pension is maintained in full.

The issue of compensation and social guarantees for different worker categories in Spain is strictly regulated. For example, employers are required by law to compensate for overtime, which also affects the rights of employees with health limitations.

Overall, changes in the pension system are aimed at taking into account the real possibilities of people with severe illnesses and not penalizing them for being unable to work until the age of 65. For other citizens, the rules for retirement remain the same.
