Court Orders Medical Examination to Assess Condition of Elisa Muliaa

In Madrid, actress fails to appear for a second time to testify in defamation case

A Madrid court has ordered a medical examination of Elisa Muliaa. The actress once again failed to appear at the hearing on Íñigo Errejón’s defamation suit. The court’s decision is related to her claim of incapacity.

In Madrid, a judge has ordered a medical examination of actress Elisa Muliáa to determine whether she is truly unable to testify in a defamation and slander case initiated by former deputy Íñigo Errejón. Muliáa has failed to appear in court for the second time in a row, citing a medical certificate for an anxiety disorder as her reason for absence. The judge offered her the possibility to testify via video call, but the actress refused, after which it was decided that a court-appointed doctor should visit her to assess her condition.

Prolonged proceedings

The hearing is taking place at the Plaza de Castilla courthouse. In addition to Errejón, one of the key witnesses was questioned on Friday. Previously, in March, the session had already been postponed due to the absence of Muliáa and her lawyer Alfredo Arriena. At that time, the actress’s defense also cited medical reasons, and later the lawyer reported the need for surgical intervention. As a result, the court set a new date, but this time as well, the actress did not appear.

Recently, Muliáa changed her attorney for the defamation case, leaving Arriena only for the case concerning alleged sexual assault. The new representative filed a motion to dismiss the case and postpone the questioning, but according to the court, the documents were not submitted on time. Errejón, who arrived in court, expressed confidence that the actress would have to answer for her statements.

The substance of the accusations

Errejón’s lawsuit is linked to Muliaa’s posts on social media, where she claimed that the former deputy allegedly pressured witnesses to testify in his favor. This concerns a couple living in the apartment where, according to the actress, the incident occurred in October 2021. These witnesses testified via video call from Australia and stated that they had not noticed anything suspicious. Muliaa accused Errejón of manipulation, and in one of her posts, claimed that he had ‘blackmailed’ her witnesses. On Friday, one of them confirmed in court that there had been no pressure from Errejón.

Case overlaps and new allegations

The story began in the fall of 2024, when journalist Cristina Fallarás reported that several women had filed complaints against a Madrid politician. Soon, Íñigo Errejón came into the spotlight; he resigned and issued a statement on the contradictions between his private and public personas. That same day, Muliaa went to the police, accusing him of sexual assault: according to her, Errejón kissed her without consent and then committed a series of sexual acts in the apartment and later at another location. Afterwards, the actress repeatedly attempted to withdraw from the process, citing deteriorating mental health, but the court continued to consider the case.

The Prosecutor’s Office insists on acquitting Errejón, maintaining that the acts were consensual and ceased when Muliaa withdrew her consent. In February 2026, the actress’s lawyer filed another complaint—this time from a different woman, who also accuses Errejón of sexual assault. However, the court denied her the status of a protected witness and closed the case due to lack of evidence for the accusations.

Context of the legal proceedings

The situation with key participants failing to appear and hearings being postponed echoes other high-profile trials in Spain, where defendants avoid direct questioning. For example, in the ‘Kitchen operation’ case, former Prime Minister Mariano Rajoy also testified regarding allegations of surveillance and destruction of evidence, as covered in detail in the report on the court proceedings involving Rajoy.
