At the beginning of 2024, an incident occurred on board the Carnival Radiance cruise ship that became the subject of a court case in the United States. Diana Sanders, a 45-year-old nurse from California, sustained serious injuries after falling down a staircase. According to the court, this resulted from excessive alcohol consumption permitted and encouraged by ship staff. As reported by Talent24h, a federal court in Miami found Carnival Cruise Line guilty of negligence and ordered the company to pay the victim $300,000 in compensation, equivalent to approximately 250,000 euros.
The essence of the case was that over a nine-hour period, from midday until late evening, Sanders consumed at least 14 shots of tequila at one of the ship’s bars. According to the defense, the bar staff should have stopped serving her alcohol once it was clear she was heavily intoxicated. However, they failed to do so, and shortly after her last order, the woman fell down the stairs, suffering a concussion, back injuries, a bruised tailbone, and multiple contusions.
Incident details
The fall occurred at night, when Sanders was found unconscious in an area designated for crew only. This fact was also discussed in court, as it raised concerns about access control and safety on board. During the proceedings, surveillance camera footage was examined, which made it possible to reconstruct the sequence of events: from Sanders leaving the casino bar to her discovery following the fall.
The court ruling was based on the conclusion that the company had acted negligently by allowing the sale of alcohol to continue to the passenger despite clear signs of intoxication. These circumstances became key in delivering the verdict in favor of the victim.
Reaction of the parties
Diana Sanders’ attorney, Spencer Aronfeld, emphasized that the case against the major corporation was complex and lasted for 18 months. According to him, the situation highlighted the risks associated with unlimited alcohol packages on cruises, as well as the pressure on bar staff, who often prioritize tips over guest safety. Carnival Corporation, in turn, expressed disagreement with the court’s decision and announced its intention to appeal, believing there are grounds for a retrial.
Context and significance of the decision
This case again raises the issue of balancing the commercial interests of cruise companies with their responsibility for passenger safety. In recent years, courts have increasingly heard cases related to injuries in transport and tourism, where the adequacy of precautionary measures and client behavior control becomes central. In particular, as demonstrated by a recent analysis on trends in Catalonia’s case law, courts are increasingly requiring companies and institutions to provide indisputable evidence of their responsibility or innocence in disputed situations.
The landmark ruling in the Carnival Cruise Line case could serve as a benchmark for other market players, forcing them to review their internal service standards and controls over onboard alcohol sales. The question of where the line is drawn between the personal responsibility of passengers and the duties of the company remains open and requires further discussion.
