
In Madrid, the trial for the high-profile case of a fatal street race on the M-30 ring road has been suspended. The reason is the sudden disappearance of one of the main defendants—BMW driver Francisco M., who vanished just days before the final hearings. The court must now wait for his arrest or voluntary appearance, and all hearings will have to be repeated with a new jury.
The Defendant’s Escape
The situation became more complicated when Francisco M., accused of participating in the race that led to the death of an uninvolved driver, failed to appear at a key hearing. Judge Rosa María Quintana San Martín explained that it is impossible to proceed with the trial without one of the defendants: this could render the entire process invalid due to a violation of the parties’ rights. According to her, the inability to compare the statements of both participants makes it unacceptable to deliver a verdict.
Immediately after Francisco M.’s disappearance, he was declared wanted, first across Spain and then internationally. The judge reported that there is reason to believe the defendant may have left the country. His lawyer stated that she does not have any information about her client’s whereabouts.
Case Details
The incident under investigation occurred on July 25, 2021. According to the investigation, after a conflict during an overtaking maneuver between a BMW driven by Francisco M. and a Fiat Punto driven by Rafa M., both vehicles began a dangerous race on the M-30, greatly exceeding the speed limit. As a result, a third road user, Juan Lopez, who was not involved in the conflict, was killed.
The prosecution classifies the incident as intentional homicide and dangerous driving, demanding 15 years in prison for both defendants. Rafa M.’s defense insists on a less severe charge—manslaughter—which carries a sentence of 1 to 5 years in prison. Francisco M.’s lawyer is seeking full acquittal, arguing that he was merely trying to evade pursuit.
Consequences for the trial
The court proceedings were nearly concluded: only the testimony of the two defendants remained to be heard. However, the disappearance of Francisco M. forced the judge to suspend the process. Now, if the fugitive is found, the hearings will start over, and a new jury will be assembled. The judge emphasized that until this point, both defendants had complied with all court orders and regularly reported to the police, so there was no reason for their pretrial detention.
After the announcement of the suspension of the proceedings, the jurors expressed a wish to meet with the family of the deceased, who were present in the courtroom. The judge noted that the case has particular public significance, as it concerns road safety and trust in the judicial system.
